The terms “we,” “us,” and “our” refer to NeuroQuest Kids. NeuroQuest Kids operates this website and online store, including all related information, content, features, tools, digital products, downloadable materials, and services offered through it collectively referred to as the “Services.”
Our store is hosted and powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.
These Terms of Service, together with our Privacy Policy, Refund Policy, and any other policies published on our website, describe your rights and responsibilities when accessing or using the Services.
By visiting our website, purchasing a product, downloading materials, creating an account, or otherwise using the Services, you agree to be bound by these Terms of Service.

Product images, covers, boxes, books, binders, cards, worksheets, or other physical-looking presentations shown on our website may be digital mockups created to illustrate the contents of the downloadable product.
The purchase of a digital product gives you a limited license to use the product. It does not transfer ownership of the intellectual property, designs, illustrations, text, trademarks, or underlying files to you.

SECTION 5 — PROHIBITED USE OF DIGITAL PRODUCTS
You may not, without our prior written permission:
- Resell or redistribute the digital files.
- Share the files through email, messaging applications, cloud folders, social networks, websites, forums, groups, or file-sharing platforms.
- Upload the files to Google Drive, Dropbox, OneDrive, Telegram, Facebook groups, marketplaces, repositories, or public databases for access by others.
- Give the files to another household, customer, teacher, school, business, or organization.
- Sell printed or modified versions of the materials.
- Use the materials to create a competing product.
- Copy, reproduce, extract, trace, translate, modify, or adapt substantial portions of the materials for resale or redistribution.
- Remove copyright notices, branding, watermarks, trademarks, or identifying information.
- Claim the materials as your own.
- Use the materials in paid memberships, courses, subscription libraries, coaching programs, schools, clinics, therapy practices, or businesses without an appropriate license.
- Use automated systems or artificial intelligence tools to extract, replicate, train on, reproduce, or create derivative commercial products from our materials.
- Circumvent download limits, security controls, or access restrictions.
Unauthorized sharing or redistribution may result in termination of access, cancellation of licenses, refusal of future service, and legal action where appropriate.
SECTION 6 — EDUCATIONAL PURPOSE AND PARENTAL SUPERVISION
NeuroQuest Kids products are designed as educational and recreational resources for use by parents, guardians, caregivers, educators, and children under appropriate adult supervision.
Our materials are not intended to replace:
- Medical advice.
- Psychological treatment.
- Behavioral therapy.
- Occupational therapy.
- Speech therapy.
- Educational assessment.
- Diagnosis.
- Medication.
- Professional healthcare services.
NeuroQuest Kids does not diagnose, treat, cure, or prevent ADHD or any other medical, developmental, psychological, neurological, or behavioral condition.
Any references to focus, attention, confidence, emotional regulation, routines, memory, independence, or cognitive skills describe the intended educational themes of the activities. Individual experiences and results vary.
You are responsible for determining whether a particular activity is appropriate for the child using it.
An adult should supervise activities involving scissors, pencils, writing tools, small objects, movement exercises, or any other materials that could present a risk if used improperly.
Stop an activity if it causes distress, frustration, discomfort, or safety concerns.
SECTION 7 — PRODUCT INFORMATION
We make reasonable efforts to describe our products accurately. However, product descriptions, images, mockups, previews, colors, illustrations, page counts, file organization, bonuses, and presentation may occasionally contain minor differences.
Colors and appearance may vary depending on:
- Screen settings.
- Device type.

Eligible purchases are covered by our 30-Day Money-Back Guarantee, subject to the conditions described in our Refund Policy.

Purchases, refund eligibility, exclusions, processing times, technical access issues, duplicate purchases, and refund abuse are governed by our Refund Policy.
When a full refund is issued:
- Your license to use the refunded digital product is revoked.
- You must stop using the materials.
- You must delete downloaded copies where reasonably possible.
- You may not continue printing, sharing, distributing, or exploiting the refunded product.
- We may disable related download links or account access.
Refunds are processed to the original payment method unless otherwise required by law.

The Services and all materials available through them are owned by or licensed to NeuroQuest Kids and are protected by applicable copyright, trademark, design, and intellectual property laws.

“NeuroQuest Kids,” associated logos, product titles, designs, slogans, and visual branding may be trademarks or protected commercial identifiers.
Nothing in these Terms transfers any intellectual property ownership to you.
All rights not expressly granted are reserved.
SECTION 13 — THIRD-PARTY SERVICES AND LINKS
The Services may use or link to third-party platforms and providers, including:

SECTION 14 — RELATIONSHIP WITH SHOPIFY
NeuroQuest Kids is powered by Shopify, which enables us to provide the online store and related Services.
However, purchases made through our store are transactions directly between you and NeuroQuest Kids.
Shopify is not the seller of NeuroQuest Kids products and is not responsible for the content, quality, performance, delivery, refund, or use of our digital products.
To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims arising directly from purchases made from NeuroQuest Kids, except where Shopify has independent legal responsibility.
SECTION 15 — PRIVACY
Personal information collected through the Services is handled in accordance with our Privacy Policy.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.
SECTION 21 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, NeuroQuest Kids and its owners, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from:

Where liability cannot legally be excluded, our total aggregate liability relating to a purchase will not exceed the amount you paid for the product giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, you agree to indemnify and hold harmless NeuroQuest Kids, Shopify, and their respective affiliates, owners, employees, contractors, agents, licensors, and service providers from third-party claims, damages, losses, liabilities, and reasonable legal costs arising from:

- Your infringement of another person’s rights.

These Terms do not limit consumer rights that cannot lawfully be waived or excluded.
Customers in certain jurisdictions may have statutory rights relating to digital content, including remedies when digital content is defective, inaccessible, or materially different from its description.
For customers in the European Union, statutory rules may apply to digital-content conformity and withdrawal rights. The withdrawal right for immediately supplied digital content may end after delivery begins when the customer has expressly consented to immediate performance and acknowledged the resulting loss of that right. These statutory rules operate separately from our voluntary 30-day guarantee.
Where mandatory local law conflicts with these Terms, the mandatory legal requirement will apply.
SECTION 24 — GOVERNING LAW AND DISPUTES
These Terms and any dispute relating to the Services will be governed by the laws applicable to the jurisdiction in which NeuroQuest Kids is legally established, without excluding any mandatory consumer protections that apply in your place of residence.
Before initiating formal proceedings, you agree to contact us at legal@neuroquest.store and provide a reasonable opportunity to investigate and resolve the issue.
Nothing in this section prevents either party from seeking urgent relief relating to fraud, security, misuse, or intellectual property infringement.
SECTION 25 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or removed to the minimum extent necessary.
The remaining provisions will continue in full force and effect.
SECTION 26 — WAIVER
Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
A waiver is effective only when expressly provided in writing by an authorized representative of NeuroQuest Kids.
SECTION 27 — ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy, and other policies published on the website, constitute the entire agreement between you and NeuroQuest Kids concerning the Services.
They replace prior communications or agreements relating to the same subject matter.
SECTION 28 — ASSIGNMENT
You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without our prior written consent.
